1. Introduction
1.1. Daman Store – “Dman” is the trade name of the Daman Store – Dman group of companies listed in Appendix 1. Each company within the Daman – Dman group (“Daman” or “we“) operates an e-commerce platform consisting of a website and mobile application (collectively, the “Store“), along with supporting IT infrastructure, logistics, and payment systems, for the sale and purchase of consumer products and services (“Products“) within its designated region as specified in Appendix 1 (“Territory“).
1.2. These General Terms and Conditions apply to sellers and buyers on Daman Store and govern your use of the Daman Store website and any related services.
1.3. By using Daman Store, you fully accept these General Terms and Conditions. If you do not agree to these terms in whole or in part, you must not use Daman Store.
1.4. You agree that the term “you” in these General Terms and Conditions refers to:
An individual user,
The concerned person,
A company, or
A legal entity, unless otherwise required.
1.4.1. A customer may not create more than one account on the website. If additional accounts are detected, Daman reserves the right to block the extra accounts.
2. Registration and Account
2.1. You must be at least 18 years old to register on Daman Store. By using the Store or agreeing to these terms, you confirm that you meet this age requirement.
2.2. When registering for an account, you will be required to provide an email address/username and password. You agree to:
2.2.1. Maintain the confidentiality of your password;
2.2.2. Notify Daman immediately (via the contact methods provided or through the “Contact Us” form) if your password is compromised;
2.2.3. Accept full responsibility for any activity on Daman Store resulting from your failure to keep your password secure. You may be held liable for losses arising from such failure.
2.3. You must use your account personally and may not transfer it to any third party. You are responsible if you delegate account management to a third party.
2.4. Daman reserves the right, at its sole discretion and without prior notice or justification, to:
Suspend or cancel your account,
Modify account details.
3. Product Returns and Replacements
3.1. Return requests by buyers and acceptance of returned products by sellers are managed by Daman in accordance with the Returns Policy on the Daman Store website (subject to periodic updates). Acceptance of returned products is at Daman’s sole discretion and complies with applicable laws in the Territory.
3.2. Replacements of returned products are managed per Daman’s Returns & Replacements Policy (subject to updates). Daman may offer replacements at its discretion, considering:
3.2.1. The product’s price;
3.2.2. Local and/or international shipping fees (as stated on the Returns page);
3.2.3. Free replacement and shipping from Daman Store.
3.3. Returned products are accepted and replaced by Daman on behalf of the seller.
3.4. Updates to the Returns or Replacements Policy apply to all purchases made after the revision date.
4. Payments
4.1. Payments due under these Terms and Conditions must be made per the payment instructions on Daman Store.
5. Promotions
5.1. Promotions/contests by Daman or other promoters are governed by the Promotion Terms and Conditions, available on our website/app.
5.2. The maximum quantity per customer for promotional products is determined by the shopping cart. To ensure fair access, duplicate orders may be canceled.
6. Data Privacy and Confidentiality
6.1. Sellers agree to the processing of their personal data per Daman’s Privacy and Cookie Notice.
6.2. Daman processes all personal data obtained through the Store and related services per its Privacy and Cookie Notice.
7. Breach of Terms and Conditions
7.1. Accounts may remain indefinitely active, subject to these Terms.
7.2. If you breach these Terms or if Daman suspects a violation, Daman may:
7.2.1. Temporarily suspend your access;
7.2.2. Permanently ban your access;
7.2.3. Block your IP address;
7.2.4. Request ISPs to restrict your access;
7.2.5. Suspend/delete your account;
7.2.6. Take legal action (contractual or otherwise).
7.3. You must not circumvent access restrictions (e.g., creating alternate accounts).
8. Entire Agreement
8.1. These Terms, along with Daman’s policies/guidelines (and, for sellers, the Seller Terms), constitute the complete agreement between you and Daman, overriding all prior agreements.
9. Review and Amendments
9.1. Daman may revise these Terms, Seller Terms, and policies periodically.
9.2. Revised Terms apply from the date of publication on Daman Store.
10. Severability
10.1. If any clause is deemed illegal/unenforceable, the remaining clauses remain valid.
10.2. If a clause can be made enforceable by removing part of it, the modified clause will apply.
11. Assignment
11.1. Daman may assign, transfer, or subcontract its rights/obligations under these Terms.
11.2. You may not assign your rights/obligations without Daman’s written consent.
